Summary (plain English): FixMyStay provides temporary-use equipment to make a stay workable. Items remain owned by FixMyStay unless you complete a buyout. You're responsible for items while you have them.

1. What FixMyStay Is

FixMyStay provides temporary-use equipment and comfort infrastructure to guests staying in short-term or temporary accommodations.

Items are provided for temporary use only. They are not leased, not sold, and not permanently installed, unless explicitly purchased through a buyout option.

2. Temporary Use License

You are granted a limited, non-transferable, temporary license to use the items during your rental period. Ownership always remains with FixMyStay unless a buyout is completed.

3. Rental Period & Extensions

  • All rentals are billed in 3-day blocks.
  • Extensions must be approved through the FixMyStay platform.
  • Items may not be kept beyond the agreed rental period without approval.

Maximum rental duration: 90 days. After that, items must be returned or purchased.

4. Pricing, Caps & Continuation

Prices are displayed at checkout. Certain items may have:

  • Rental caps for medium-length stays (time-limited to 30 days).
  • Continuation fees after a cap window (for approved temporary continuation).
  • Buyout options that allow you to keep the item.

All applicable pricing, caps, continuation fees, and buyout details are shown clearly in your order summary.

5. Deposits & Authorization Holds

Some items require an authorization hold on your payment method. This is not a charge unless used to cover loss, major damage, or failure to return items.

Unused holds are released after return and inspection, subject to bank processing times.

6. Proper Use & Responsibility

You agree to:

  • Use items safely and appropriately.
  • Follow any provided instructions.
  • Not modify, disassemble, or repair items.
  • Not lend, transfer, or sub-rent items.

You are responsible for items while in your possession.

7. Damage, Loss & Normal Wear

  • Normal wear is acceptable.
  • Major damage, loss, or non-return may result in charges.
  • FixMyStay determines condition and charges in good faith based on inspection.

8. Delivery & Pickup

  • Delivery and pickup windows are scheduled.
  • You must provide accurate access instructions (doorman/front desk/guest present).
  • Missed pickups or access failures may incur fees.

9. Safety Disclaimer

Items are provided for temporary support and convenience. Items are not medical devices and are not intended for permanent installation. You agree to use items responsibly and in accordance with local safety requirements.

10. Limitation of Liability

To the maximum extent permitted by law, FixMyStay is not liable for indirect, incidental, consequential, special, or punitive damages. FixMyStay's total liability is limited to the amounts you paid to FixMyStay for the applicable order.

11. Governing Law

This agreement is governed by the laws of the State of New York, and disputes will be handled in New York, NY, unless otherwise required by law.

12. Acceptance

By placing an order, you agree to this Guest Agreement and our Privacy Policy.
